TERMS & CONDITIONS

- PAYMENT -

 

Regular Menu Orders:

  1. All regular orders off of our current cupcake menu must be placed and confirmed 5 days in advance, however, order quantities of 5 dozen or more must be placed and confirmed 15 days in advance. All regular menu orders must be paid in full at the time of ordering.

  2. Any request that deviates from our standard cupcake decor (cupcakes decorated as stated in flavor description) will be considered a custom order request and is subject to an upcharge depending on the complexity of the design requested.

Custom Orders:

  1. All custom orders must be placed and confirmed 15 days in advance. For small custom orders (4 dozen and less), orders are to be paid in full at the time of ordering. For large custom orders (5 dozen or more), we require a 50% non-refundable deposit due at the time of placing your order to secure your booking. The remaining balance is due 5 days prior to your scheduled pick-up or delivery date. Payment may be paid in full when booking.

  2. It is highly recommended to place your order as far in advance as possible so that we can guarantee availability. Please keep in mind that schedules tend to fill up around holidays and other popular occasions that are seasonal (graduation, wedding season, etc.).

All orders will be invoiced through Square and must be paid by credit-card prior to pick-up or delivery.

 

 

 

- CHANGES & CANCELLATIONS -

  1. Order changes for regular menu orders which do not impact the price or which increase the price will be considered at least 5 days in advance to the scheduled pick-up or delivery date, provided that any increase is paid at the time of the change. Order changes for custom orders which do not impact the price or which increase the price will be considered at least 9 days in advance prior to the scheduled pick-up or delivery date, provided that any increase will be added to your final invoice which is due 5 days before pick-up or delivery. Any changes made beyond these day limits will not be accepted. No exceptions. Changes to an order which result in a reduction in the price must be made at least 5 days in advance to the scheduled pick-up or delivery date for online orders and at least 9 days in advance for custom orders. For regular menu orders, your order will be fully refunded and a new invoice will be made and sent to be paid immediately. For custom orders, in excess of the non-refundable deposit, any decreasing order amount will be subtracted from the final payment due.

  2. Due to our baking schedule and ingredient/material ordering, any custom order cancellations must occur a minimum of 8 days before scheduled pick-up or delivery time and for regular menu orders, 4 days prior to your scheduled pick-up or delivery time. Any order canceled within the 8 days (custom orders) or 4 days (regular menu orders) prior to pick-up or delivery are subject to full charge of the placed order. Please understand that each order spot reserved is dedicated to the customer who holds it to ensure that your order is properly planned, baked, and decorated. We are unable to unbake, undecorate, and reverse the time spent on your order.

 

 

- DESIGN -

  1. We give Julia Nikolaus Cupcakery & Co. the right to add small additional design elements (free of charge) that fit within the design/scope of the agreed upon design to further enhance the overall look of the order.

  2. Julia Nikolaus Cupcakery & Co. takes pride in providing cupcake designs that are unique in nature and we will not directly re-create another artist’s work (copying pictures exactly as seen on Pinterest, Instagram, etc).

- ALLERGENS & INGREDIENTS -

  1. Julia Nikolaus Cupcakery & Co. is a licensed Limited Food Establishment in the state of Pennsylvania through the Department of Agriculture.

  2. The Julia Nikolaus Cupcakery & Co. kitchen space is NOT gluten-free or allergen-free. Julia Nikolaus Cupcakery & Co. processes known allergens such as tree nuts, peanuts, wheat, dairy, corn, soy, gluten, eggs, etc. By accepting these terms and conditions, you agree to notify your guests of allergen risks and cannot hold Julia Nikolaus Cupcakery & Co. liable for any allergic reaction due to ingredients in, on, or around any products provided by Julia Nikolaus Cupcakery & Co.

  3. In accordance with Pennsylvania state requirements, ingredient lists are available by request.

- PHOTOGRAPHY -

  1. Julia Nikolaus Cupcakery & Co. reserves the right to take and use photographs of your cupcake order(s) to use for marketing, advertising, and promotional purposes without compensation to you.

  2. Julia Nikolaus Cupcakery & Co. will not send photos of cupcake orders to the client for “pre-approval” prior to pick-up or delivery.

- CUPCAKE CARE & STORAGE CONDITIONS -

  1. During transport, sit your cupcakes flat on the floor of your vehicle with the A/C on and out of direct sunlight. We do not recommend someone holding the order. During transport, drive with care (no sudden stops or turns) and do not leave your order in a hot car or in direct sunlight.

  2. Do not swing or bump the bag that your cupcake box is stored in. Hold the bag level and flat. When taking your cupcake box(es) out of your bag, hold the cupcake box flat and do not tilt the box in any way. Support the bottom of the box when carrying.

  3. If your cupcakes have fondant decor, you do not need to refrigerate - just place in A/C or a cool area out of direct sunlight. If your cupcakes are buttercream only and will not be eaten on the day of pick-up or delivery, refrigerate them and take them out an hour before serving. They are best at room temp! 

  4. The client assumes full responsibility for choosing a pick-up or delivery day and time that best aligns for the date of the event in which the cupcakes will be consumed. Our cupcakes are best enjoyed within 2 days after pick-up or delivery.

 

- PICK-UPS & DELIVERIES -

  1. We deliver up to a 20 mile radius from Columbia, PA. Our delivery fees start at $5 for a 1-5 mile radius. Thereafter, we charge $1 per mile (one direction). Exceptions on the 20 mile delivery radius may be made for wedding bookings.

  2. We also offer pick-up options if you would like to opt out of delivery. Pick-up day and time availability is listed on our contact page but must be arranged with the Owner prior. Pick-ups are in Columbia, PA. Please understand that pick-up times are firm. If you will be arriving late to pick up an order, please let us know as soon as possible. Early pick-ups are not considered.

  3. All deliveries will be made within a strict agreed upon half-hour delivery window. We will ring the doorbell and wait for 5 minutes for someone to come to the door. If no one comes to the door, your order will not be delivered and the client will be required to pick up the order as we do not handle re-deliveries after the first attempt. By placing an order and choosing delivery, you acknowledge that you are responsible for being present to accept the order being delivered during the agreed upon timeframe. Due to various weather conditions, we will not leave an order at your doorstep unless agreed upon to do so. If this is the case, the client holds full responsibility for anything that may happen to the order given that the order would be exposed to natural elements (heat, rain, snow, wind, etc). We cannot be held responsible for any circumstances beyond our control that may delay the arrival of your order (weather conditions, extreme traffic, etc.). If delays are expected, we will contact you immediately with the contact information that we have on file for you.

  4. If you placed an order as a gift for delivery, you acknowledge that you take full responsibility to let the giftee know exactly when the delivery will be taking place and that a temperature sensitive item is being delivered. After one delivery attempt, the client will be required to pick up the order on behalf of the receiver as we do not handle re-deliveries after the first attempt. We operate on a planned delivery schedule in order to take care of all of our clients orders and deliveries.

  5. Julia Nikolaus Cupcakery & Co. is not responsible for anything that may happen to your order (drops, frosting melting from the client leaving cupcakes in the heat/humidity, tumbled cupcakes from a rough car ride, etc.) after pick-up or satisfactory delivery. We will not give refunds (partial or full) or replace your order if something may happen to your order after a satisfactory pick-up or delivery. By accepting these terms and conditions, you agree to allow us to take a picture of your order when the order has been delivered or right before pick-up. This simply protects us to prove that your order has been delivered or handed over intact and as intended. Refunds (partial or full) and order remakes will not be made as the client assumes full responsibility for the condition of the order once it leaves our hands and possession.

 

 

 

- SATISFACTION POLICY -

We hope that each of our customers are fully satisfied with the products that they purchase. In the unlikely event that you are not happy with your order, please let us know and we will be happy to make it right. These situations are handled on a case-by-case basis, but please note that we do not provide refunds (partial or full) as all sales are final. However, we will fix mistakes or provide a coupon/discount towards a future purchase.
